Heller affirmed
Word from SCOTUSblog is that Antonin Scalia wrote the majority opinion in the 5-4 split striking down DC’s gun bans and affirming an individual right under the 2nd Amendment, with Breyer writing a main dissent and an unknown Justice writing a concurring dissent.
When they have the opinion, I’ll have the link to it.
Revisions/extensions (9:27 am 6/26/2008) – They have the opinion. I’m going through it as soon as I hit “save”.
R&E parts 2 and 3 (10:59 am and 11:08 am 6/26/2008) – Scalia’s opinion is mostly a thing of beauty. There are a couple of quibbles regarding too much deference given to bad precedent, but considering we were but a Kennedy away from no gun rights outside of the auspices of a government organization, I’ll take it. Indeed, Heller is part of a government organization and was seeking to extend his “militia” right to his private residence.
Also, Chris, the BBA Master of Arms, is now taking suggestions for a date to hold a BBA shoot in honor of Heller.

Wisconsin’s own embarrassment, Russ Feingold, has fully flip-flopped on filibustering the FISA compromise reached by the White House and Congress.
Feingold when the compromise was reached (via WisPolitics):
"The proposed FISA deal is not a compromise; it is a capitulation. The House and Senate should not be taking up this bill, which effectively guarantees immunity for telecom companies alleged to have participated in the President’s illegal program,….”
Feingold on Tuesday as reported by the Green Bay Press-Gazette:
Feingold said he and other Senate opponents won’t try to stop the vote, but they “won’t allow it to pass quickly.”
Instead, Feingold, D-Wis., told an audience at the New America Foundation that he plans to highlight the bill’s flaws in floor speeches.
Feingold yesterday per the Huffington Post:
“This is a deeply flawed bill, which does nothing more than offer retroactive immunity by another name. We strongly urge our colleagues to reject this so-called "˜compromise’ legislation and oppose any efforts to consider this bill in its current form. We will oppose efforts to end debate on this bill as long as it provides retroactive immunity for the telecommunications companies that may have participated in the President’s warrantless wiretapping program, and as long as it fails to protect the privacy of law-abiding Americans.” (emphasis added)
I wonder if Feingold remembers what happened to the last liberal ‘Rat who told his home-state constituents one thing and did the exact opposite. Does Tom Daschle ring a bell? Hopefully the Wisconsin GOP will finally have its act together by 2010.

I-94 soon to be back to 2 lanes each direction at the Rock/Crawfish Rivers
JSOnline’s DayWatch reports the potentially-good news. The water levels on the Rock and Crawfish Rivers are dropping, and the DOT will be able to examine the closed westbound bridges for damage. If there is none, the crossovers built to get westbound traffic onto one of the eastbound lanes and avoid the very-lengthy detour on Hwy. 83, I-43 and I-39/90 will be shut down and traffic will get to use both lanes each way.
DOT spokesman Dennis Shook (my Waukesha readers can tell you stories about him) had a, shall we say, interesting quote on the crossover: “Even though they are going slow, people are happy they are able to travel westbound at all. Five or 10 miles an hour on the crossover is better than getting detoured all the way down to Beloit.” It is a matter of perspective and timing. If one avoids the Hwy. 83 portion of the old detour, I’d rather be doing 70 or so down 43 and 90 than doing 5-10 mph on the 5-mile crossover and the couple miles leading up to the crossover. That said, if I don’t have to be there during the crunch times, I’d rather have that crossover.

Jim Geraghty found an ancient bus-tossing incident in Barack Obama’s second book, The Audacity of Hope. Quoting from the book:
Increasingly, I found myself spending time with people of means – law firm partners and investment bankers, hedge fund managers and venture capitalists. As a rule, they were smart,interesting people, knowledgeable about public policy, liberal in their politics, expecting nothing more than a hearing of their opinions in exchange for checks. But they reflected, almost uniformly, the perspectives of their class; the top 1 percent or so of the income scale that can afford to write a $2,000 check to a political candidate. They believed in the free market and an educational meritocracy; they found it hard to imagine that there might be any social ill that could not be cured with a high SAT score. They had no patience with protectionism, found unions troublesome, and were not particularly sympathetic to those whose lives were upended by movements of global capital. Most were adamantly prochoice and were vaguely suspicious of deep religious sentiment…
I know that as a consequence of my fund-raising I became more like the wealthy donors I met, in the very particular sense that I spent more and more of my time above the fray, outside the world of immediate hunger, disappointment, fear, irrationality, and frequent hardship of the other 99 percent of the population – that is, the people I’d entered public life to serve.
While Jim focuses on what Obama thinks of those donors, I’ll point out that they’re using Obama and his friends to keep the numbers of those that can afford the $2,000 (now adjusted for inflation) donations to the absolute minimum. After all, some animals are more equal than others, even though the grease is the same.

Folks, remember the words of The Indispensible One – “All Barack Obama statements come with an expiration date. All of them.” It’s just a matter of figuring out when a particular utterance curdles and sours.

“Snagged”? More like “Caught Not Teaching Properly”.
The former word is the lede in this JSOnline DayWatch article on the growing number of schools and school districts that simply refuse to teach to a minimum standard, including Milwaukee Public Schools and Racine Unified. It’s a word that one would expect from WEAC and MTA, not a news organization that supposedly is interested in proper education.
I do have issues with the federal government having to lay down the law, but it’s painfully obvious that nobody in Wisconsin has the balls to hold MPS and RUSD accountable for creating uneducated dolts.

Rep. Paul Ryan’s staff has provided me with a follow-up on an item from GOPgal in yesterday’s Scramble. He has signed Rep. Lynn Westmoreland’s pledge to vote to increase drilling. The simply-worded petition reads as follows – “I will vote to increase U.S. oil production to lower gas prices for Americans.”

This just popped in the inbox from Americans for Prosperity, who are putting on the Hot Air Tour exposing the economic nightmare that is “Global Warming” (there will be a stop at Miller Park July 26)…
FYI breaking news from our team on the ground in Nashville. The Nashville Parks Department is denying us permission to launch the balloon, citing the fact that our permit says balloon rides but not specifically the word “launch.” This despite the fact that we have explained to them on the phone multiple times our precise flight plan and before today there was no indication that there was a problem or any defect in our permit. Clearly, Gore is calling in favors to stop the embarrassing visual and negative coverage surrounding our event and ratcheting up the beating he is taking over his home energy use. Please post about this on blogs and pass this information along to allies. Thanks.

Roy Wilson at the Nashville Parks Department must not have liked our earlier post, since he just completely revoked our permit — even though his department’s own rules state that he can’t do that unless we break a law or one of the department’s rules, which we haven’t done and have no intention of doing. Then he hung up on our legal counsel.
In the meantime, good news to report — we’ve secured a private location for this afternoon’s event. We’ll be in a field at the corner of Sneed and Vaughn Roads — just about a mile and a half from the original event location….

- Cuffy Meigs (D’OH! on the misattribution) notes Obama’s u-turn comes only days after Tim Russert, the guy who Obama made one of the public financing promises to, passed away. Could we be seeing Zombie Russert taking revenge soon?
- Cam Edwards introduces a new campaign-ism – Barack-tracking. Odds the Indispensible One picks this up – very good (memo to ego – it’s because he and Cam are good friends).
- Sean Hackbarth found yet another “exaggeration” from Obama. It seems he wasn’t around when the bill that extended health care benefits for veterans, something he’s taking credit for, was considered and voted upon in the Senate.
- Ed Driscoll whipped up a killer Barack the Pooh video.

The money quote – “If (the assumption that health care costs can be brought closer to wages) cannot be accomplished, given the assumptions put forth by the plan’s supporters themselves, the program will face a shortfall of between $4.79 billion and $10 billion by 2017. The tax rate on businesses will have to increase to 13.51% and on employees to 4.62% in order to keep the program solvent in just nine years.”

- GOPgal lists the members of the House who support (or at least claim to support) the proper solution; more drilling. Somebody needs to explain to Rep. Jim Sensenbrenner that the introduction of ANWR oil to the world market, even if it doesn’t make it to Wisconsin, will reduce prices just as much as if it does make it to Wisconsin.
One more thing; where’s Paul Ryan? He’s usually smart on items like this.
- Purple Avenger warns that because we’re driving less, the gas tax is going to go up. After all, government can never live with only what they had last year.
- Headless Blogger has the new slogan for the corn crop. One thing; our “friends” at ADM (and thus in the governor’s mansion) want but one of those three choices.

And as I typed this up, the shower passed over and the NWS issued a short-term forecast (at 11:07 just as the shower popped up)…
Scattered showers have rapidly developed over southern Dodge…northeast Jefferson…and central Milwaukee County. These showers are capable of producing heavy downpours as they push southeast around 40 mph.
Some cities impacted by these showers through midnight include Sullivan…Mukwonago…Oak Creek….and Racine.
There is a small scale cold front over eastern Fond Du Lac…Washington…and Milwaukee counties that is pushing southwest around 15 mph. Look for gusty northeast winds and temperatures falling into the lower 50s rapidly with the passage of the front. The front should pass through Waukesha and Kenosha by midnight.
I was unable to find an overnight forecast from WITI-TV/DT (Channel 6); they had already transtioned their website’s forecast to tomrrow. Note the only entity that even raised the possibility of rain was The Weather Channel, and then they deemed the chance of rain so slight that it didn’t merit an actual mention in the forecast.
And people wonder why I don’t buy Gorebal “Warming” or whatever the acolytes are calling the anti-American/anti-capitalist line of bullshit nowadays. They can’t even get the fucking forecast for the next 3 hours right.
